IRC Section 121 Personal Residence Gain Exclusion Combined With 1031 Tax Deferred Exchange for "Mixed Use" Property.
For the sale of property: (1) formerly used as a residence but used as a rental at the time of the transaction; (2) on which two separate buildings are located, one a personal residence and the other used as an office or rented; and (3) a personal residence with an allocated portion used as a home office or rented, a portion of the gain relative to personal use may qualify for the personal residence gain exclusion under IRC Section 121 and a portion of the gain relative to the portion held for the productive use in a trade or business or for investment purposes may be deferred as an exchange under IRC Section 1031 if required qualifications are met. These rules are complicated and contain certain base requirements. We work with our clients and their accountants to apply these rules post sales and for planing future sales.
